The NeMolchiKZ Foundation reported on another case of violence in Kazakhstan.
In Aktau, five men born between 1991 and 2001 attacked a girl who was returning home – they beat her, pushed her into a car, forced her to take drugs, raped her, and also took out a loan in her name and forcibly kept her in the car all night until they found a way to withdraw money. Three days later, the girl died after jumping out of a window of a high-rise building.
The tragedy occurred in May last year. The prosecutor requested life imprisonment for the main rapist, and up to 16 years in prison for the other four. However, as the foundation states, the judge reclassified the charges during the trial.
What happened
The brother of the deceased Kazakhstani woman contacted the NeMolchiKZ foundation. According to information from the activists, the young girl was returning home on the night of May 14-15, and she was noticed by five men who had previously purchased drugs.
The men attacked the girl and, as the foundation writes, beat her, after which they forced her into a car, blindfolded her so that she would not understand where she was, and kept her at the gas station all night.
"In the car, one of them, under threat of gang rape, forced [her] to take mephedrone and raped her in a perverted manner right in the car. He threatened to beat the deceased if she did not watch the video to the end, where "a naked man sticks a can in his anus", and she had to watch this video. The rapist is a married man, a family man, raising a child," the foundation said in a statement.
Then, according to NeMolchiKZ, the criminals took out a loan for two million tenge from the deceased’s phone, then dropped her off in the city in the early morning, threatening that if she told anyone about it, they would find her and kill her.
The deceased nevertheless told her friend everything, and she told her brother, who, as NeMolchiKZ writes, found the gas station and one of the criminals.
"The brother called his sister and said that she needed to write a statement, that he would go to the end and punish everyone. He promised to be there during the investigation and trial. The girl seemed to agree. But a few minutes later, she jumped out of the window right in front of her friend," the foundation said in a statement.
What happened next
The criminal case went to court.
"The prosecutor requested life imprisonment for the main rapist. The other four received 15-16 years. The articles under which the investigation and the prosecutor's office found them guilty were: 120, 121, 105, 299, 296, 126, 125, 194. These were: rape, violent sexual acts, incitement to suicide, incitement to drug use, illegal handling of drugs, illegal deprivation of liberty, kidnapping, extortion. But Judge Iniyatulla Raushanbekovich Dosetov reclassified the charges during the trial . The grounds were that the girl jumped out of the window herself, and did not die during the kidnapping, beating, detention, rape, or from forced drug use. She died after jumping from the ninth floor three days after that horrific incident,” the NeMolchiKZ foundation states.
In addition, the foundation reported that during the investigation, the qualification of the actions of each of the participants in the crime changed. At the same time, according to the public, 4 of the 5 suspects had a criminal record.
"The girl's family filed an appeal. They sincerely believed that such a crime by drug addicted repeat offenders would be judged fairly. But in the end: 4 out of 5 criminals can be released on parole in 3-4 years," the foundation concluded.
