A Shymkent court sentenced a young man who broke into a pawnshop with a toy gun and threats. The criminal was stopped by an 18-year-old visitor, who was later awarded a certificate. This was reported by the press service of the Supreme Court.
"In Shymkent, a criminal, having burst into a pawnshop wearing a medical mask, threatened a pawnshop employee with a toy gun and demanded 100 thousand tenge. In the inter-district criminal court of Shymkent, a criminal case against the accused was received under Article 24, Part 3 – Article 191, Part 2, Clause 1 of the Criminal Code (attempted open theft of someone else's property with the threat of violence)," the report says.
The prosecutor changed the charges during the court debate, excluding the qualifying feature "with the threat of violence". Mitigating circumstances were defined as admission of guilt, sincere remorse for the act, young age, no criminal record, no aggravating factors were established. According to the law, the punishment for an attempted crime cannot exceed 3/4 of the maximum term.
"The investigation of the case was conducted in an accelerated manner, in connection with which the punishment cannot exceed ½ of the maximum term. In this connection, the defendant was sentenced to a restriction of freedom for a period of one year and six months," the court concluded.
