A resident of Temirtau was denied a lawsuit against the Department of Employment and Social Programs to recognize the inaction in providing him with a modular hand prosthesis as illegal, NUR.KZ reports with reference to the Karaganda Regional Court.
As reported in the official Telegram channel of the courts of the Karaganda region, the court considered the administrative claim of a citizen who claimed that the defendant did not provide him with a hand prosthesis using new technology, did not provide the service “Registration of documents for providing persons with disabilities with prosthetic and orthopedic care” and violated the procedure for providing persons with disabilities with prosthetic and orthopedic care.
In the response, the defendant indicated that the plaintiff did not provide technical specifications for the hand prosthesis using new technology (modular). In this regard, three price offers were requested from prosthetic centers in Kazakhstan.
On October 9, 2023, the department announced a procurement by request for price proposals, since there are no guaranteed prices for hand prostheses.
On October 16, following the results of the procurement, the winner was declared to be the "Kogershin" public organization, with which an agreement was signed on October 26 to provide the man with a hand prosthesis using new technology.
On November 7, the contract was terminated due to the plaintiff’s failure to appear for prosthetics.
On February 19, 2024, following the results of the state procurement, contract No. 21 was concluded for the manufacture of a hand using new technology with the NGO "Organization of Disabled People "Center for Assistance to People with Disabilities". The contract is at the stage of termination due to the plaintiff's failure to appear for prosthetics.
On September 20, the defendant announced a new public procurement. The contract was sent to JSC "Republican Prosthetic and Orthopedic Center" for signing.
By the decision of the SMAS dated October 10, 2024, the claim was dismissed. The court noted that the defendant had repeatedly carried out public procurement before filing the administrative claim, thereby taking the necessary actions related to the acquisition of a hand prosthesis for the plaintiff.
The decision has not entered into legal force.
